  • We assisted client on obtaining planning permission for development on a partly greenfield partly brownfield site. The development had viability issues due to significant upfront remediation costs. Due to the viability issue, a subsequent planning application was made for a larger scheme which included £500k of planning obligations and affordable housing
  • This scheme was also not viable, the Council therefore requested a new full application, however, we persuaded the Council to accept an application for a non-material amendment to alter the description of the development instead, and then a s73 application to vary the plans and s106 agreement
