Our insolvency team has extensive experience of personal insolvency matters, including acting for creditors in pursuing bankruptcy petitions against individuals or responding to a bankruptcy petition which may have been issued against you.

We advise on all aspects of individual insolvency, including bankruptcy and IVAs. Many of our cases involve an international element, and our lawyers have extensive experience of assets located in other jurisdictions.

Individuals

We act for individuals who are the subject of claims against them or who may have been served with a bankruptcy petition. We appreciate the significant stress this will place on you and your family, and support you by providing sympathetic and practical advice on the best options available     .

We also advise company directors who may have given personal guarantees or are concerned about claims which may be brought against them arising out of their position as a director.

Creditors

We advise a variety of creditors, including other individuals, financial institutions, lenders and landlords when default occurs and enforcement becomes necessary. We advise on the enforcement of security and on strategies for debt recovery, including litigation to recover the debt and/or commence bankruptcy proceedings against the debtor.

Insolvency practitioners

We frequently act for insolvency office-holders and have acted on some of the most high profile bankruptcies in recent years.

  • Investigating and prosecuting claims on their behalf, from straight forward debt/asset recovery actions to more complex statutory and common law claims against debtors and third parties
