The discussion is intended as a useful guide not only to independent administrators but to the wide network of practitioners that commonly support them (from the non-contentious and contentious private client to corporate and property litigation teams).

Points of discussion:
- Context:Â Why was an independent administrator appointed? Are there family tensions? Getting the estate administered in difficult circumstances.
- Getting the basics right: Who is the client? What are the independent administrator’s duties and the rights of beneficiaries? The thorny issue of retentions pending possible claims.
- Property issues: Regulatory concerns arising from the deceased’s properties, changing the locks, duties to tenants and responsibilities of the IA as landlord, insurance, possession proceedings and clearance of tenant items from properties.
- Corporate issues:Â What if a sale is imminent? Do the shares need to be voted before a Grant? How does a company deal with the death of a major shareholder (in particular, a sole shareholder and Director)?
